You agree that you have the ability to store such electronic communications so that they remain accessible to you in an unchanged form.

After you consent to receive electronic communications from Gatewood you may receive internal marketing information from Gatewood. You may choose to reject internal marketing information from Gatewood. If you choose to not receive internal marketing information from Gatewood, you must notify Gatewood of your decision.

VII.   Jurisdiction and Governing Law

The Website and these Website Terms will be deemed to have been made in Birmingham, Alabama. The Website, and all matters arising from or relating to your use of the Website, the Website Terms, and any and all claims arising out of your relationship with the Gatewood shall be governed by and in accordance with the laws of the United States Government and the State of Alabama, excluding its conflict of laws provisions.

Gatewood make no representation that functions or information found at the Website are appropriate or available for use at other locations outside of the United States and access to them from territories where their contents are illegal is prohibited. You may not use the Website or export the information found on or at this Website in violation of United States or other export laws and regulations. Gatewood and the Website’s users agree that any dispute arising out of or relating to these Website Terms or the Website, and/or the interactions contemplated hereby or thereby, including, without limitation, any such dispute between Gatewood and any present or former officer, employee or agent of Gatewood, each of whom is intended to be a third-party beneficiary of the agreement contained in this paragraph, shall be resolved through litigation in the federal court located in Birmingham, Alabama or, in the event such court lacks subject matter jurisdiction, in the state court located therein, and the parties hereby irrevocably consent to personal jurisdiction in the courts thereto. Gatewood and the Website’s users hereby waive, to the fullest extent permitted by applicable law, any right to trial by jury with respect to any action or proceeding arising out of or related to the Website Terms or the Website.

VIII.   Limitation of Liability

In no event, including but not limited to negligence, shall Gatewood, or any of its subsidiaries, affiliates, directors, officers, employees, agents, or service providers (collectively, “Protected Entities”) be liable for any direct, indirect, special, incidental, consequential, exemplary, or punitive damages arising from, or directly or indirectly related to, the use of, or the inability to use, the Website or the content, materials, or functions related thereto, your provision of information via the Website, lost business or lost sale.

XII.   Assignments and Delegations

You may not assign the Website Terms or the rights hereunder without the prior written consent of Gatewood. Gatewood may assign the Website Terms and delegate certain of its responsibilities, obligations, and duties under or in connection with the Website Terms to a third party or affiliate, which may discharge those responsibilities, obligations, and duties on behalf of Gatewood.

As part of the user registration process, which may be necessary to obtain access to certain products or services, or content on the Website, registration information must be provided to Gatewood. You represent that your registration information is accurate and truthful. Gatewood reserves the right to reject your user registration by disabling your registered account.   • Comments deemed to be spam or solely promotional in nature will be deleted. Including a link to relevant content is permitted, but comments should be relevant to the post topic.
  • Comments including profanity will be deleted.
  • Comments containing language or concepts that could be deemed offensive will be deleted. Note this may include abusive, threatening, pornographic, offensive, misleading or libelous language.
  • Comments that attack an individual directly will be deleted.
  • Comments that harass other posters will be deleted. Please be respectful toward other contributors.

Gatewood reserves the right to edit or delete any comments submitted to its blog without notice.

VIII.   Forum

Gatewood may provide you access to an Internet forum on its website to facilitate online discussions and information sharing. Gatewood's forum is equipped with a commenting capability. While Gatewood invites you to share your opinions and questions in its forum, they must not be used to distribute spam messages, post commercial advertisements, attack other people, or spread links to malicious or dangerous websites. Gatewood retains the right to moderate any comment or other type of written content submitted to its forum and to remove any content it deems to have violated its policies.

Gatewood does not endorse the use of the forum for sales and other similar transactions between the forum's users. Additionally, Gatewood cannot guarantee the accuracy of information or the safety of any external links its forum might contain. Therefore, Gatewood is not responsible for any problems or damage that occurs as a result of people making use of information or material contained in its forum.

IX.   Banner Advertising

Gatewood may use such third-party advertising companies to serve ads when you visit the Website.  This third-party advertising companies may also separately place or recognize a cookie file on your browser in the course of delivering advertisements to the Website. Using cookies or other technology, these companies may use information about your computer and your visits to this and other websites in order to provide advertisements about goods and services of interest to you.

X.   Juveniles

Gatewood does not market its products and services towards juveniles. If you are under eighteen (18) years of age, you may not access Gatewood's products or services. Gatewood does not knowingly collect or solicit personal information from or about children under eighteen (18) years of age. Additionally, if Gatewood discovers it has received any information from a child who is under thirteen (13) years of age, Gatewood will delete that information immediately. If you believe Gatewood has any information from or about anyone under the age of thirteen (13), please contact Gatewood immediately.

XI.   Jurisdiction and Governing Law

This Policy will be deemed to have been made in Birmingham, Alabama. The Policy and any and all claims arising out of your relationship with the Gatewood shall be governed by and in accordance with the laws of the United States Government and the State of Alabama, excluding its conflict of laws provisions.

Gatewood and the Website’s users agree that any dispute arising out of or relating to the Policy or the Website and/or the interactions contemplated hereby or thereby, including, without limitation, any such dispute between Gatewood and any present or former officer, employee or agent of Gatewood, each of whom is intended to be a third-party beneficiary of the agreement contained in this paragraph, shall be resolved through litigation in the federal court located in Birmingham, Alabama or, in the event such court lacks subject matter jurisdiction, in the state court located therein, and the parties hereby irrevocably consent to personal jurisdiction in the courts thereto. Gatewood and the Website’s users hereby waive, to the fullest extent permitted by applicable law, any right to trial by jury with respect to any action or proceeding arising out of or related to the Policy.

XII.   Limitation of Liability

In no event, including but not limited to negligence, shall Gatewood, or any of its subsidiaries, affiliates, directors, officers, employees, agents, or service providers (collectively, “Protected Entities”) be liable for any direct, indirect, special, incidental, consequential, exemplary, or punitive damages arising from, or directly or indirectly related to, the use of, or the inability to use, information relating to the Policy.

In no event shall the Protected Entities be liable for or in connection with any content posted, transmitted, exchanged, or received by or on behalf of any user or other person on or through the Website. In no event shall the total aggregate liability of the Protected Entities to you for all damages, losses, and causes of action arising from the Policy or your use of the Website exceed, in the aggregate, the amount, if any, paid by you to Gatewood for your use of the Website and its services.

XIII.   Indemnification

You agree to defend, indemnify, and hold the Protected Entities harmless from any and all claims, liabilities, costs and expenses, including reasonable attorneys’ fees, arising out of or related in any way to your use of the Website and its services, your placement or transmission of any message, content, information, software, or other materials through the Website, or your breach or violation of the law or of this Policy. Gatewood reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and in such case, you agree to cooperate with Gatewood’s defense of such claim.

Gatewood reserves the right to modify or supplement the Policy at any time without notification to you. You are responsible for regularly review Gatewood’s Policy to observe any changes.

CALIFORNIA PRIVACY POLICY & DISCLOSURES

I.   Introduction

Gatewood Supply Company, LLC (“Gatewood” or "we") respects your privacy and is committed to providing a transparent notice of our Privacy Notice and Disclosure for California Residents. This Privacy Notice and Disclosure for California Residents applies solely to those who reside in the State of California (“consumers” or “you”). The purpose of this privacy notice and disclosure is to inform California residents of their rights as part of our privacy policies.

II.   Your Right to Know

You have the right to request that Gatewood disclose what personal information it collects, uses, and discloses. You can do this through a verified consumer request. That process is described below in the section titled “Submitting a Verified Consumer Request.”

We may collect personal information, which means information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household (“personal information”). Personal information includes, but is not limited to, contact information (e.g., name, address, email, etc.), usage information (e.g., the webpages you visit), device and browser data (e.g., your IP address), information from page tags (e.g., cookies to collect usage information), and log data (e.g., data about the time when the webpages are accessed).

Gatewood does not, and will not, sell personal information.

III.   Your Right to Request Deletion of Your Personal Information

You have the right to request that Gatewood delete any of your personal information collected or maintained by it, subject to certain exceptions. You can do this through a verified consumer request.

We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:

  • Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.
  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
  • Debug products to identify and repair errors that impair existing intended functionality.
  • Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
  • Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.).
  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement, if you previously provided informed consent.
  • Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
  • Comply with a legal obligation.
  • Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

IV.   Submitting a Verified Consumer Request

You have the right to submit verified consumer requests to know information or for deletion. The request to know can be for any or all the following about you:

  1. Specific pieces of personal information that Gatewood has;
  2. Categories of personal information Gatewood has collected;
  3. Categories of sources from which the personal information is collected;
  4. Categories of personal information that Gatewood sold or disclosed for a business purpose;
  5. Categories of third parties to whom the personal information was disclosed for a business purpose; and
  6. The business or commercial purpose for collecting personal information.

The request to "delete" is to delete any of your personal information collected or maintained by Gatewood, subject to certain exceptions. You may only make a verifiable consumer request to know information twice within a 12-month period. We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm that the personal information relates to you. We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

You can submit requests to Gatewood via [email protected] to request your personal information or to delete your personal information. Once we receive your consumer request, we will send you an acknowledgement message within 10 days which will describe our verification process. We will respond to your request within 45 days, if we are able to verify your identity. Requests for deletion will require a separate confirmation that you want your information deleted.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request. Please note we are unable to disclose or provide you with government issued identification numbers, financial account numbers, any health insurance or medical identification numbers, an account password, or security questions and answers.

V.   Using an Authorized Agent to Submit a Request

Only you, a person registered with the California Secretary of State, or a person you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child. If you use an authorized agent, you may provide a power of attorney executed pursuant to California Probate Code sections 4000 to 4465.

If a power of attorney that meets those provisions is not submitted, you will be required to verify your identity directly by submitting a verified consumer request according to the procedures in the section titled “Submitting a Verified Consumer Request.” If anyone purporting to be an authorized agent for a consumer contacts us, we will require proof that the authorized agent has been authorized to act on the consumer’s behalf.

VI.   Your Right to Non-Discrimination for the Exercise of a Privacy Right

We will not discriminate against you for exercising any of your California Consumer Privacy Act ("CCPA") rights. Unless permitted by the CCPA, we will not:

  • Deny you goods or services.
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
  • Provide you a different level or quality of goods or services.
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.
However, we may offer you certain financial incentives permitted by the CCPA that can result in different prices, rates, or quality levels. Any CCPA-permitted financial incentive we offer will reasonably relate to your personal information’s value and contain written terms that describe the program’s material aspects. Participation in a financial incentive program requires your prior opt in consent, which you may revoke at any time.

VII.   Other California Privacy Rights

Gatewood does not respond to web browser “do not track” signals or other mechanisms. Other parties may collect personally identifiable information about your activities over time and across different websites when you use our website or services.

VIII.   Changes to Privacy Notice

Gatewood reserves the right to amend this privacy notice at our discretion and at any time. Your continued use of our website following the posting of changes constitutes your acceptance of such changes.

TERMS OF SALE

A. General

I.   Introduction

By placing an order for products and/or services with Gatewood Supply Company, LLC (“Gatewood”), you are confirming that you agree to Gatewood’s Terms of Sale (“Terms”).  When used in these Terms, “you,” “your,” and “user” refers to any individual, company, or legal entity that accesses or uses https://www.gatewoodsupplyco.com/ (“Website”) and the products and services it provides.

II.   Affidavit of Customer

By ordering products and/or services from Gatewood, you hereby agree and swear to the following affidavit:

  • By selling or delivering products to me, Gatewood is not violating any federal, state, or local laws, ordinances or regulations.
  • I am not currently less than eighteen years old.

III.   Product Descriptions and Defective Parts

Gatewood’s product and service descriptions are provided as accurately as possible. However, due to the exotic nature of many of Gatewood’s products and services, on occasion it can be difficult to correctly distinguish or properly classify features of the products and services. If you receive a new product and believe it is not representative of its description, please send the unused product back to Gatewood for a refund, which will be provided per the company’s return policy under the Terms. A used product may not be returned for a refund under Gatewood’s return policy if you do not consider the product to be representative of the product’s description.

Any defective or out of specification product will need to be addressed directly with the manufacturer of the product. Gatewood will assist in putting you in contact with the manufacturer of the product to get the product replaced or fixed if the product falls under the warranty of that manufacturer.


IV.   Order Cancellations

If your order is cancelled for any reason, you must pay a 3.5% order cancellation fee. 

You cannot cancel an order once it is placed because the Website order system automatically submits all orders for immediate packing and shipping. You understand that Gatewood may cancel your order at any time if you have not abided by the Terms, or any other applicable terms, conditions, and policies relied upon by Gatewood. If Gatewood cancels an order, a refund will be provided to you.

You should not request that Gatewood ship packages to any area that is prohibited by federal, state, or local law. If such an order is discovered, the order will be cancelled and Gatewood will offer a refund.

V.   Restocking Fee

A 20% restocking fee will be charged on all cancelled orders that have been processed by Gatewood. These fees apply unless the product is defective or damaged upon arrival, you received the wrong product, or the fee is prohibited by law. Occasionally Gatewood will inadvertently over-sell a product. In that event, Gatewood will contact you and offer a refund or the option to backorder the product.

VI.   Return Policy

Products that are shipped as 100% new and are returned exactly as they were shipped may be returned for a full refund. Any new products that cannot be restocked as 100% new as they were shipped to you are considered used.

All returns will need to be returned in new condition to be eligible for return or exchange. You understand and agree that Gatewood does not accept returns of used products unless (1) the products are damaged in shipping or are defective upon arrival and (2) Gatewood is notified of such damage or defect within five (5) business days of delivery to the address specified. All products are offered “AS IS” and “AS AVAILABLE” without warranties of any kind, either expressed or implied.  You understand that all sales are final and made without warranty of merchantability or otherwise, except as mentioned elsewhere in Gatewood’s terms, conditions, and policies. When a return is allowed, and an over-sold product is not involved in the transaction, Gatewood may either replace the damaged or defective product or issue a refund of the purchase price at its sole discretion.

Requests for return, exchanges or issues need to be made within fourteen (14) days of an order that has shipped.

For safety reasons, no returns or exchanges on ammunition are permitted.

Shipping charges or return shipping charges are not eligible for refund.

Gatewood is not responsible for lost or damaged products resulting from improper packing or shipping.

VII.   Shipping Liability and Risk of Loss

All products purchased from Gatewood are made pursuant to a shipment contract. This means that the risk of loss and title for such products pass to you upon Gatewood’s delivery of the product to a carrier. You understand that once your package is entrusted to a common carrier (e.g., USPS, UPS, and FedEx), Gatewood does not have control over your package. Additionally, you agree that once a carrier delivers your package to the address specified, you are fully responsible for the safety of your package.

VIII.   Purchases and Payments

Gatewood accepts purchases and payments by cash, credit cards, money orders, checks, and wire transfers.

By using a credit card you hereby unconditionally waive any and all chargeback rights you may have. If you have any question about a charge on your credit card, contact Gatewood. If you deliberately or inadvertently issue a chargeback to your credit card, your account will be terminated and you agree to pay a $50 processing and collection fee.

Money orders and checks should be made payable to Gatewood Supply Company, LLC. Any returned check is subject to a $25 returned check fee. Gatewood does not accept personal checks or CODs. Gatewood will ship products immediately after receiving a full payment for an order. 


IX.   Handling Fee

At its discretion, Gatewood may apply handling fees to customer orders for the purpose of covering the costs of the resources expended in relation to order fulfillment, such as warehouse storage costs and packing costs. If a handling fee is applied to customer transactions, the handling fee will be charged once per order but not to each individual product in an order. The handling fee will be tiered in the following manner: (1) orders under $10.00 have a $1 handling fee, (2) orders between $10.00 and $999.99 have a $2 handling fee, and (3) orders that are $1000.00 or more have a $4 handling fee.

X.   Layaway and Financing

All customers making layaway purchases through Gatewood Supply Company’s website are subject to all of Gatewood’s terms, conditions, and policies, as well as the terms and conditions utilized by its primary layaway vendor, Sezzle, set forth in the following site: https://legal.sezzle.com/user

When using layaway, or other financing options, to makes purchases with Gatewood, purchase cancellations, modifications, price adjustments, and refunds are not allowed after either partial or full payment is made by the purchaser. Additionally, the purchaser may risk forfeiture of all payments if a layaway transaction is not completed by him or her for any reason not deemed reasonable or acceptable by Gatewood. Unless full payment is received by Gatewood, items will be returned to stock.

XI.   Product Conditions and Grades

Gatewood categorizes its products according to their condition, as determined by fit, finish, and function. Generally, Gatewood places batches of parts into listings that share a similar condition and, as a result, items are selected randomly from these batches after a purchase is made. However, with some parts, Gatewood separates batches of parts into a variety of grades, which are determined by their distinctly different conditions, to allow customers to specifically select items with a specific type of condition. Customers who purchase a part with a specific grade will be provided with an item that is reasonably determined to be in the condition that is associated with that grade.


XII.   Hand Select Option


For certain parts, we offer a hand select option.  Hand select typically means we will pick you the best 1 out of 3 parts when looking at exterior cosmetics.  Please know that hand select does not mean your item will be perfect since we will be looking at exterior cosmetics only.  Therefore, hand select does not guarantee any specific condition, but hand select does mean your item will have the best exterior of the parts that are examined for your particular order. If there are 2 parts or less in stock, then hand select means the best looking part within the currently available supply will be selected.

XIII.   Gift Certificates


Purchasing, Sending and Receiving Gift Certificates
  • Gift certificates are void where prohibited or restricted by law.
  • Except as provided herein, gift certificates have no cash value.
  • Gift certificates are not valid until payment has been received and successfully processed by Gatewood.
  • Gatewood reserves the right to refuse service or reverse any gift certificate purchase for any reason and return the funds to the purchaser.

Redeeming Gift Certificates

  • Gift certificates are only redeemable at Gatewood for the amount, product, or service specified on the gift certificate, by the expiration date indicated. The default expiration date for each gift certificate is 365 days following its acquisition by a customer.
  • Gatewood reserves the right to convert gift certificates to their monetary value, equivalent to what was paid for the gift certificate, at its option and sole discretion. Gift certificates acquired with Gatewood rewards points will not be converted to cash or any equivalent of cash.
  • Except as required by law, gift certificates are not redeemable for cash and cannot be returned for a cash refund.
  • Any unused balance of the gift certificate will remain until redeemed or the original expiration date indicated on the gift certificate, whichever occurs first.
  • If a purchase exceeds the amount listed on the gift certificate, the redeemer is responsible for paying the difference at time of purchase.
  • For security purposes, a recipient may be required to provide valid ID before he or she can redeem the gift certificate.
  • Use and redemption of Gatewood's gift certificates are also governed by all other Gatewood policies.
  • Gatewood may provide gift certificate purchasers with information about the redemption status of gift certificates.

Cancellation and Expiration of Gift Certificates

  • Gatewood reserves the right to immediately invalidate gift certificates, without notice, should it receive a credit card chargeback, returned check or other form of repudiated payment made towards the gift certificate.
  • Gatewood is not responsible for lost or stolen gift certificates. Reasonable and prudent steps are taken to verify the legitimacy of a redeemer and upon full redemption or at the expiration date, the gift certificate will be identified as not valid for payment of any kind.
  • Gatewood reserves the right to dishonor the gift certificate, if it reasonably believes it was not validly purchased, has already been redeemed, or the redeemer stole or is otherwise not the intended beneficiary of the purchaser.
  • Gift certificates are not valid or redeemable after the expiration date indicated on the gift certificate.
  • Gatewood may choose to replace a valid lost gift certificate, provided the original gift certificate hasn't been redeemed and the replacement is issued to either the original purchaser or a verifiable recipient.
  • Gatewood reserves the right to contact gift certificate purchasers, or known recipients, to remind them of upcoming expiration dates.

Miscellaneous Terms and Conditions for Gift Certificates

  • Gatewood is not responsible for emailed gift certificates that do not reach their intended recipient for reasons beyond its control. Bounced email is not monitored. Receipt of gift certificate emails cannot be verified.
  • Risk of loss will pass to the purchaser of the gift certificate upon the electronic transmission of such gift certificate to the recipient.
XIV.   Customer Loyalty Rewards Program

Gatewood's Customer Loyalty Rewards Program (the “Program”) entitles customers (“Customers”) to take advantage of certain rewards (“Rewards”) that may change from time to time and, which may be made available for limited times, all as determined by Gatewood in its sole discretion. Without notice, Gatewood may, in its sole and absolute discretion, cancel, change, suspend or modify any aspect of the Program or any Program Rewards at any time, including the availability of any Program Rewards.

Program Period

This Program will continue until terminated, suspended, modified, or converted to another rewards program by Gatewood.

Eligibility

To become a Customer with the Program, you must have a user account on Gatewood's Website and be logged into it when an online transaction is completed.

Earning Points

Once you have become a Customer with the Program, you may begin earning rewards points (“Points”) in the following ways:
  • Every time a purchase of a product or service from Gatewood's online store occurs, a buyer earns 1 Point for every $1 spent per order (excluding tax, shipping charges and fees).

Without notice, Gatewood reserves the right to suspend, terminate, revalue or modify, without liability to Customers, all or part of the Points’ value structure and offers and any merchandise or service. Gatewood reserves the right to adjudicate all Points discrepancies in its sole discretion, and the Customers agree to abide by any such adjudication. Customers check your Points balance on their user account page.

Points Redemption

The Points are redeemable towards purchases of gift certificates on the Website. If you choose to apply Points to your purchase, you will not able to select the amount of your Points that are applied to the order. If you have more Points than are necessary to complete a purchase, the appropriate number of Points will be applied and deducted from your account to complete the purchase; points not needed to complete the purchase will remain in your account. If you have Points in your account, but not enough to complete the purchase, the purchase will not be finished successfully.

Refunds & Returns

Any items received as a result of Points redemption may only be exchanged for a refund of the applicable Points redeemed for such item (i.e., Points are not redeemable for cash or credit).

Points Minimums And Maximum

You cannot redeem Points for more than the total amount of your purchase. Points are not redeemable for cash or an equivalent of cash.

Points Balance

Customers may always check their Point balance in their user account page on the Website.

Reward Conditions

Rewards may be taxable, depending on the value of the item and the federal, state, and local tax laws applicable to the Customer. Customers are solely responsible for reporting such items on their tax returns and paying any associated tax liability. Customers may not assign or transfer any Rewards. Gatewood makes no warranty in any respect as to any Rewards, merchandise or service available within the Program.

Termination

Gatewood may, in its sole and absolute discretion, cancel, change, suspend, or modify any aspect of the Program and/or any Reward at any time, including the availability of any Reward. Gatewood may, in its sole and absolute discretion, terminate or suspend any Customer’s participation in the Program for breach of these terms, or for taking any actions that are inconsistent with the intent of these terms. Gatewood reserves the right at its sole discretion to prohibit any Customer from participating in any aspect of the Program if Gatewood deems or suspects that such Customer has engaged in or has attempted to engage in any of the following: (a) acting in violation of these terms, (b) damaging, tampering with or corrupting the operation of the Program or Website, (c) acting with intent to annoy, harass or abuse any other person, (d) demonstrating any inappropriate, uncooperative, disruptive, fraudulent, potentially fraudulent, or unusual behavior or activity, or (e) engaging in activity that is deemed in the sole discretion of Gatewood to be generally inconsistent with the intended operation of the Program.

Any decision Gatewood makes relating to termination or suspension of any Customer’s participation in the Program shall be final and binding in all respects. Gatewood shall be the sole determiner in cases of suspected abuse, fraud, or breach of these terms.

XV.   Jurisdiction and Governing Law

The Website and these Terms will be deemed to have been made in Birmingham, Alabama. The Website, and all matters arising from or relating to the your use of the Website, the Website Terms, and any and all claims arising out of your relationship with the Gatewood shall be governed by and in accordance with the laws of the United States Government and the State of Alabama, excluding its conflict of laws provisions.

Gatewood makes no representation that functions or information found at the Website are appropriate or available for use at other locations outside of the United States and access to them from territories where their contents are illegal is prohibited. You may not use the Website or export the information found on or at this Website in violation of United States or other export laws and regulations. If you access this Website from a location outside of the United States you are responsible for compliance with all laws applicable to you.

Gatewood and the Website’s users agree that any dispute arising out of or relating to these Terms or the Website and/or the interactions contemplated hereby or thereby, including, without limitation, any such dispute between Gatewood and any present or former officer, employee or agent of Gatewood, each of whom is intended to be a third-party beneficiary of the agreement contained in this paragraph, shall be resolved through litigation in the federal court located in Birmingham, Alabama or, in the event such court lacks subject matter jurisdiction, in the state court located therein, and the parties hereby irrevocably consent to personal jurisdiction in the courts thereto. Gatewood and the Website’s users hereby waive, to the fullest extent permitted by applicable law, any right to trial by jury with respect to any action or proceeding arising out of or related to the Terms or the Website.

XVI.   Limitation of Liability

In no event, including but not limited to negligence, shall Gatewood, or any of its subsidiaries, affiliates, directors, officers, employees, agents, or service providers (collectively, “Protected Entities”), be liable for any direct, indirect, special, incidental, consequential, exemplary, or punitive damages arising from, or directly or indirectly related to, the use of, or the inability to use, the Website or the content, materials, or functions related thereto, your provision of information via the Website, lost business or lost sale.

In no event shall the Protected Entities be liable for or in connection with any content posted, transmitted, exchanged, or received by or on behalf of any user or other person on or through the Website. In no event shall the total aggregate liability of the Protected Entities to you for all damages, losses, and causes of action arising from the Terms or your use of the Website exceed, in the aggregate, the amount, if any, paid by you to Gatewood for your use of the Website and its services.

XVII.   Indemnification

You agree to defend, indemnify, and hold the Protected Entities harmless from any and all claims, liabilities, costs and expenses, including reasonable attorneys’ fees, arising out of or related in any way to your use of the Website and its services, your placement or transmission of any message, content, information, software, or other materials through the Website, or your breach or violation of the law or of these Terms. Gatewood reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and in such case, you agree to cooperate with Gatewood’s defense of such claim.

B.   Domestic Order Policies

I.   Introduction

Magazine and/or other parts will not be shipped to locations where they are not legal and/or restricted. Please contact your local government or the  Bureau of Alcohol, Tobacco, Firearms and Explosives too find out more about rules and restrictions in your area. Magazine repair and replacement kits may be shipped as long as it is agreed that they are sold as repair and replacement kits only and should not be assembled without compliance with all laws.

II.   Magazine, Ammunition, and Firearm Laws

All federal, state, and local laws, regulation, and ordinance apply to your orders with Gatewood.

The following list of state and local laws is not represented to be all inclusive of the numerous firearms, ammunition and magazine laws found within the United States. You must be aware of any laws affecting your purchase and are responsible for ensuring they are upheld. Individual federal, state, and state laws are too numerous to list on the Website, however, the following sales restrictions will apply:

  • California: 10-round magazine limit (or provide Law Enforcement Identification.) No repair or magazine rebuild kits.
  • Hawaii: 10-round limit on pistol magazines (or provide Law Enforcement Identification.) No high capacity pistol magazines or ammunition sales.
  • Illinois: Must have current copy of FOID card and state photo identification.
  • Maryland: 20-round magazine limit (or provide Law Enforcement Identification.) No high capacity magazine sales.
  • Massachusetts: Must provide high capacity magazine permit before ordering (or provide Law Enforcement Identification.)
  • New Jersey: 15-round magazine limit (or provide Law Enforcement Identification.) No high capacity magazine sales.
  • Ohio: No sales of magazines with over 30 rounds capacity.
  • Colorado: 15-round magazine limit (or provide Law Enforcement Identification.) No high capacity magazine sales.

US Territories:

Counties:

  • Napa, California: No ammunition deliveries.
  • Yolo, California: No ammunition deliveries.
  • Montgomery, Maryland: No ammunition deliveries.

Cities:

  • New York State & City of New York: No magazines over 10 rounds (or provide Law Enforcement Identification.) New York dealers must have appropriate city licenses. No sales of high capacity magazines manufactured after 09/14/1994.
  • Washington DC: No magazine sales unless LEO. 
  • Los Angeles, California: Please check local and state laws before ordering ammunition.
  • Oakland, California: Please check local and state laws before ordering ammunition.
  • San Francisco, California: Please check local and state laws before ordering ammunition.
  • Chicago, Illinois: No sales of ammunition and magazines within city limits.
  • Annapolis, Maryland: NO ammunition deliveries.

C.   International Order Policies

Currently, Gatewood does not accept or ship international orders due to the cost and labor required to satisfy all laws and regulations controlling such orders, and no exceptions are made. All International Traffic in Arms Regulations rules & regulations apply to this policy. However, Gatewood’s policy towards international orders may change in the future, so you are urged to regularly check Gatewood’s prevailing policy on international orders on the Website.
